1. Agreement
These Terms of Service ("Terms") govern your use of edusparklab.life and your relationship with EduSpark Lab Inc. ("EduSpark Lab", "we", "us"), an edtech curriculum and teaching-tools design studio incorporated in British Columbia, Canada (BN 437619028 RC0001). By accessing this website or engaging our services, you agree to these Terms. If you disagree, do not use the website or our services.
2. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia, except where consumer protection legislation in your province grants non-waivable rights.
3. Nature of our services
EduSpark Lab provides professional edtech consulting, learning-experience design, AI-assisted courseware development, teacher copilot prototyping, assessment design and related delivery for client institutions and educators. We are a professional services studio — not an accredited school, college or university, and we do not issue degrees, diplomas, certificates or credentials of any kind. We do not sell courses to individuals for personal enrichment or income generation. We are not a diploma mill, not a course-selling scheme, and not an essay-writing or exam-answer service.
4. Brand and domain clarification
.life domain: The .life top-level domain is used for branding purposes only. EduSpark Lab is not a lifestyle, wellness, self-help, life-coaching or personal development brand.
"Edu": Refers to education services for institutions and educators — not a diploma-issuing body.
"Spark": Refers to igniting effective teaching and creative instructional design — not Apache Spark, not an energy or electric-vehicle brand, and not a marketing "spark" agency.
"Lab": Refers to a design and prototyping studio for teaching tools — not a science laboratory, not a research university lab, and not an accredited training facility.
5. AI-assisted services and human review
Our services involve AI-assisted content generation, courseware drafting, teacher copilot tools and assessment item suggestions. All AI outputs are subject to human review by instructional designers and client educators before use with learners. AI supports educators — it does not replace professional teaching judgement. AI-generated content, recommendations and automated feedback may be inaccurate, incomplete, biased or out of date. Clients are responsible for final approval before learner-facing deployment.
6. Academic integrity
EduSpark Lab builds tools that support honest teaching and assessment. Our tools are not designed to complete assignments, write essays, generate exam answers or enable academic dishonesty on behalf of students. Academic-integrity guardrails are integrated into our design process. Clients must not configure or use our deliverables to circumvent institutional academic integrity policies. We reserve the right to terminate engagements that seek cheating-enabling functionality.
7. No guaranteed outcomes
We do not guarantee any grade, test score, admission, certification, job placement, completion rate, revenue or learning outcome. Case studies, metrics and figures on this website reflect past illustrative engagements and are not promises of future performance. Educational results depend on many factors beyond our control including institutional context, educator practice and learner engagement.
8. Student and minor data
Where our services involve student or minor personal information, processing is governed by project contracts, PIPEDA, BC PIPA and applicable provincial privacy legislation including FIPPA for public-sector clients. We apply data governance, fairness checks and minimize data collection. Clients are responsible for obtaining required consents from learners, parents or guardians.
9. Website use
You may use edusparklab.life for lawful purposes only. You may not attempt unauthorized access, introduce malware, scrape content for commercial republication, or misrepresent your affiliation with EduSpark Lab. Content on this website is protected by copyright and may not be reproduced without written permission except for personal, non-commercial reference.
10. Professional engagements
Specific project terms — including scope, fees in Canadian dollars, intellectual property, confidentiality, deliverables and liability — are set out in separate written agreements. These Terms apply generally; contracts prevail where they conflict. Indicative pricing on our website is not an offer and is subject to change.
11. Intellectual property
Unless otherwise agreed in writing, EduSpark Lab retains ownership of pre-existing frameworks, methodologies and tools. Custom courseware and deliverables paid for by clients are typically assigned to clients upon full payment as specified in contracts. You may not reverse-engineer, resell or sublicense our proprietary methods without consent.
12. Limitation of liability
To the maximum extent permitted by British Columbia law, EduSpark Lab shall not be liable for indirect, incidental, special or consequential damages arising from website use or services. Our aggregate liability for any claim shall not exceed the fees paid by the client for the specific engagement giving rise to the claim during the twelve months preceding the claim. These limitations do not apply where prohibited by law.
13. Indemnification
Clients agree to indemnify EduSpark Lab against claims arising from client misuse of deliverables, violation of academic integrity policies, unlawful collection of learner data, or breach of these Terms — except to the extent caused by our gross negligence or wilful misconduct.
14. Disclaimer of advice
Website content and general communications are not legal, medical, psychological, financial or professional teaching certification advice. Engagements produce instructional design deliverables, not regulated professional advice.
15. Changes
We may update these Terms. The "Last updated" date will change. Material changes will be posted on this page. Continued website use after changes constitutes acceptance.
16. Severability and entire agreement
If any provision is found unenforceable in British Columbia, remaining provisions continue in effect. These Terms, together with our Privacy Policy and Cookie Policy and any signed project agreement, constitute the entire agreement for website use. Project contracts prevail for specific engagements. Provisions regarding intellectual property, confidentiality, limitation of liability, academic integrity and indemnification survive termination or expiration of any engagement. No failure to enforce any provision constitutes a waiver of that or any other provision.

18. Force majeure
Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including natural disasters, government actions, widespread network outages or labour disputes — provided the affected party notifies the other promptly and uses reasonable efforts to resume performance. This clause does not excuse payment obligations for services already delivered.
